Terms

Last updated September 29, 2026

These terms cover using The Birthday Dept. (“we”, “us”), whether your company signed up or you’re here to set up your birthday or sign a card. Using the service means you agree to them.

The service

Companies use us to run employee birthdays: a group card coworkers sign, reminders, and on paid plans a cake from Nothing Bundt Cakes or cookies from Tiff’s Treats delivered to the door.

For companies

  • Add only people who work with you, and keep the roster current.
  • Collect contact details lawfully, and don’t add anyone who has asked not to be included.
  • Home addresses and preferences you can see are for arranging birthdays only.
  • Plus is billed monthly through Stripe and can be canceled any time; it runs to the end of the paid month. Cakes and cookies are billed per birthday at the partner’s price for the package you pick, confirmed with you before the order.

For everyone

  • Be kind on cards. Don’t post anything abusive, unlawful or someone else’s private information. Admins can hide a message, and we can remove content that breaks these terms.
  • What you write on a card stays yours; you let us show it to the birthday person and the company.
  • Keep your sign-in to yourself.

Texts

The Birthday Dept. birthday texts. If you opt in on your setup page, we text you when there’s a coworker’s card to sign, once more if you haven’t signed, and with your own card on your birthday. Message frequency varies with how many birthdays your company has. Message and data rates may apply.

  • Reply STOP to any text to cancel. We’ll confirm once and send nothing more. Reply START to turn texts back on.
  • Reply HELP for help, or reach us through our contact page.
  • Carriers are not liable for delayed or undelivered messages.
  • Texting is never required to use the service. See our privacy policy for how your number is handled.

Cakes and cookies

Treats are made and delivered by our partner bakeries. We pass along the flavors and dietary notes you give us, but we can’t guarantee a treat is free of any allergen; the bakeries’ own allergen statements apply. If a delivery goes wrong, tell us and we’ll make it right.

The fine print

We work hard to get every birthday right, but the service is provided as is. To the extent the law allows, we aren’t liable for indirect losses, and our total liability is limited to what your company paid us in the three months before the claim.

We may update these terms; if a change matters, we’ll say so here and update the date at the top. Texas law governs.
